Water Rights LLC: A Contractual Breach

Mona is induced by her guardian, Newt, to enter into a contract with Water Rights LLC. The contract is for the purchase of water rights in the state of Texas. Upon signing the contract, Mona paid $500 to Water Rights LLC. The contract stated that if Mona failed to make any of her scheduled payments, she would forfeit the entire amount paid and would have no further claims against Water Rights LLC.

Mona made her first two payments on time, but she failed to make her third payment. As a result, Water Rights LLC sued her for breach of contract and was awarded $1,500 in damages.

Mona Induced by Guardian Newt: A Case of Contractual Breach

On January 1st, 2016, Water Rights LLC and Mona’s guardian, Newt, entered into a contract in which Water Rights agreed to provide educational services to Mona for a period of one year. The contract was valid and binding on both parties.

However, on March 3rd, 2016 – only two months into the contract – Newt induced Mona to breach the contract by convincing her to stop using Water Rights’ services. As a result of this breach, Water Rights suffered damages in the amount of $5,000.

Under the terms of the contract, Mona is liable for these damages. However, since she is a minor, her guardian Newt is also liable for any damages she causes. Therefore,Water Rights has the right to sue either or both parties for these damages.

A Breach of Contract Entitled the Non-Breaching Party to Sue for Monetary Damages
